Anti-Spam policy
Read this carefully.
If you use our service, you are contractually obligated to observe ALL the provisions
You may not use our services to spam others. Spamming here is the sending
of mass e-mail to people unless such people have clearly, knowingly, and intentionally
opted in to receive e-mail from you at a site owned by you. Use of compiled
lists, acquired or harvested lists, third-party opt-in lists, or deceptively
or compulsively obtained addresses is considered unsolicited spam.
This policy applies to any resource connected with spamming including, but
not limited to, originating spam from our servers, having e-mail accounts,
web sites, DNS or other services that are referenced directly, indirectly,
or implicitly by spam, the support of spamming activity, through the provision
of products that assist in the spamming process, or any related use. Accordingly,
if you purchase spamming services from an independent company rather than
doing it yourself, you are still a spammer for purposes of this document.
Why the draconian policy?
Spamming is now a felony in at least one state
of the USA. In addition, there are a number of people that get so annoyed
with spam that they will take extralegal means to interfere with service.
In addition, delivery of spam leads to blackholing of e-mail from neighboring
or related IP numbers. All of these can extremely harm the service of many
other people. Accordingly, we have a very firm policy on the matter of spamming.
One strike and you're
out
The first time we receive a complaint that you have
been spamming we will research the claim. If we determine, at our sole discretion,
the complaint is valid, use of all regular services from us will be shut down
via DNS redirect. You will then have a further 5 days to retrieve any data you
desire via your private URLs.
Regulation and monitoring
of your outbound mail traffic
Use of outbound mail from our facilities is a privilege
that can be monitored or withdrawn. In order to prohibit use of our services
for spamming purposes, and protect others using our service, we reserve the
following to ourselves:

We will monitor the anti-spam newsgroups for complaints
against your domains or IP numbers used by you. |

We reserve the right to restrict the amount of outbound
bandwidth you can consume for purposes of sending e-mails, and/or prohibit
your sending outbound mail entirely. |

|
|
If we see large volumes of outbound mail from your server
or through our e-mail service, we can and will read it to determine if it
contains spam. For this purpose, 10,000 messages and/or recipients per day
or more normally considered "large." |

|
|
If you send large amounts of legitimate mail, you may need
to tell us to configure your server to allow this. |
Financial penalties for
spamming
If we are find you are spamming, we will seek financial
redress from you via the mechanisms provided in our service agreement for any
harm caused to us, including the direct costs of researching and acting upon
complaints, costs resulting from black listing, and any other costs, as well
as and damage to our reputation, or loss of business.
How can you avoid being treated as a spammer?
Don't spam. Specifically, if you are going to send
mass mailings, make sure that everyone on that list has specifically consented
to be on that mailing list for the specific purposes of learning about your
products or services. Make sure that consent to be on the list is done in a
clear, non-coercive, and non-deceptive way. Do not purchase or use e-mail names
from other people. Many of the companies selling such names are fraudulent ventures.
But more importantly, even if these people had consented to receive information
from others about their products and services, they did not consent to receive
information from you about yours. Make sure that your site publishes a privacy
policy, and that you adhere to that policy. Similarly, make sure that people
have a convenient way to be removed from your list when they no longer want
information from you, and that if the removal process is not automated, that
you promptly remove all such names.
